Interview with “Rebecca Jones”
Hello and welcome back to Legal Lens, San Diego’s legal news source. Today, we are joined by esteemed probate attorney Steve Bliss from San Diego Probate Law. Steve, thanks for being here.
Steve Bliss Discusses Naming Beneficiaries
Steve, many of our viewers might be unfamiliar with the intricacies of estate planning. Could you explain one key step in this process?
“Absolutely, Rebecca,” Steve says, leaning forward. “One crucial aspect is naming your beneficiaries. This essentially means clearly identifying who will inherit your assets after you pass away. It’s about ensuring your wishes are honored and your loved ones are taken care of.
Think of it as writing the final chapter of your financial story. You’ve worked hard to accumulate assets throughout your life, whether it’s a home, savings, or cherished possessions. Now, you get to decide who inherits them.”
Steve continues, “The importance of naming beneficiaries can’t be overstated. Without clear designations, your estate could end up in probate court, potentially leading to lengthy legal battles and unexpected outcomes.”
He adds, “I recall one case where a client hadn’t formally named a beneficiary for their retirement account. Consequently, it ended up being divided amongst their relatives according to state law, which wasn’t aligned with the client’s intentions. It caused significant heartache and added unnecessary stress during an already difficult time.”
Steve emphasizes the need for specificity. “Don’t just say ‘my children.’ Instead, list each child by name and indicate what percentage of the asset they should receive. This clarity prevents ambiguity and ensures your wishes are carried out precisely.
The Importance of Regular Review
“Moreover, remember that life is dynamic. Relationships change, circumstances evolve. It’s crucial to review and update your beneficiary designations periodically, especially after major life events like marriage, divorce, or the birth of a child.”
He notes, “Studies show that nearly 40% of adults haven’t named beneficiaries for all their accounts,” (AARP, 2022). “Don’t become part of that statistic. Take control and ensure your legacy is protected.”
