It’s a legal process where a court appoints someone, a ‘conservator,’ to make decisions for another person, the ‘conservatee,’ who can no longer manage their own personal or financial affairs.”
What Are The Different Types of Conservatorships?
“Great question! There are actually several types. You have conservatorship of the person, focusing on things like healthcare and living arrangements. Then there’s conservatorship of the estate, which handles finances and property. For folks with developmental disabilities, we have limited conservatorships. And for urgent situations, temporary conservatorships can be put in place while a full hearing is scheduled.”
Let’s Dive Deeper into ‘Establishing a Conservatorship’. Can You Walk Us Through That Process?
Ted leans forward, ready to explain. “It all starts with filing a petition with the court. This document lays out why a conservatorship might be necessary. Then, everyone involved – the proposed conservatee and their family – needs to be notified. The court will often appoint an investigator to look into the situation and a medical or psychological evaluation is usually required. Finally, there’s a hearing where the judge reviews all the information and decides if a conservatorship is truly the best course of action.”

“You know,” Ted says thoughtfully, “sometimes families are already in a difficult place when they come to me. Emotions can run high.
