Understanding the Probate Process
Today we’re sitting down with Steve Bliss, a well-respected probate attorney here in San Diego. Steve, thanks for taking the time to talk with us today.
Of course, happy to be here.
The Importance of Handling Debts and Taxes
Steve, could you walk us through one of the key steps in the probate process?
Certainly. One crucial step is handling debts and taxes. This typically occurs after the assets have been marshaled and inventoried.
Consequently, it’s essential to identify all valid creditor claims against the estate. This can involve reviewing bills, statements, and correspondence with creditors. Ordinarily, we notify creditors formally through a process outlined by the court.
After identifying and validating the claims, the executor or administrator is responsible for paying them using funds from the estate. It’s important to remember that only valid debts are paid; unsupported claims are typically rejected.
Alongside debt management, handling taxes is paramount. Estate taxes are often due at both the state and federal levels. We work diligently with tax professionals to ensure all necessary filings are completed accurately and on time.
I recall one case where a family was unaware of a substantial outstanding debt owed by the deceased. Fortunately, we were able to identify the debt early in the process, negotiate a settlement with the creditor, and prevent it from significantly depleting the estate’s assets for distribution to heirs.
The Impact of Proper Tax Management
Data from the California Franchise Tax Board shows that approximately 15% of estates require filing of estate tax returns. Properly managing these taxes can save heirs significant amounts of money and prevent potential legal complications down the road.
